Terms of Use

These terms are a contract between you and us. They are written to be read, not to be skipped — the parts that matter most are in plain sentences.

1. Who we are

Cone Zone is operated by Oskar Szydlowski, a sole proprietor in Toronto, Ontario, Canada, trading as Cone Zone ("Cone Zone", "we", "us"). You can reach us at hello@conezone.app.

"You" means whoever is using Cone Zone — as a customer looking for ice cream, or as a truck operator listing a business.

2. What Cone Zone is, and what it is not

Cone Zone is a listings service. Independent businesses tell us where their trucks are, and we show that on a map.

We do not:

• sell, prepare, handle or deliver any food or drink
• employ, contract, supervise or control any truck, driver or operator
• inspect vehicles, kitchens, food handling or hygiene
• verify that any truck is where it says it is at any given moment
• guarantee that any truck will be trading, will have stock, or will still be there when you arrive

Every operator on Cone Zone is an independent business, responsible for its own vehicles, staff, food, permits and insurance. Any dealing between you and an operator — including anything you buy — is between the two of you.

3. Accuracy, and what a pin actually means

A pin means an operator has told us a truck is at that place. We take reasonable steps to keep that honest: pins expire, we ask operators to confirm they are still there, and pins come down when a truck leaves. None of that makes a pin a promise.

Community sightings — pins reported by other members of the public — are marked as unverified and are exactly that. They are somebody's word.

Do not rely on Cone Zone where being wrong would cost you something you care about. Check with the operator if it matters.

4. Your account

• You must be old enough to enter a contract where you live. Cone Zone is not intended for children to sign up to on their own.
• Keep your password to yourself. You are responsible for what happens through your account.
• Tell us promptly at hello@conezone.app if you think somebody else has got into it.
• You can close your account at any time.

5. If you run a truck

This section applies to operators. By listing a business you confirm that:

• you hold, and will keep, every permit, licence and approval the law requires for your business — including a valid mobile food vendor permit where one is needed
• you comply with all food safety, health, vehicle and employment law that applies to you
• you carry whatever insurance is appropriate for your business
• the information you give us — including your permit number — is true
• you will only check in where your truck actually is, and will end a check-in when you leave

Checking a permit number is an administrative step on our side. It is not an inspection, an endorsement, or a statement that your business is safe or lawful. That remains yours.

Your indemnity to us

If someone brings a claim against us because of your business — your food, your vehicle, your staff, your permits, or something you posted — you will cover our reasonable losses and legal costs in dealing with it. This does not apply to the extent the claim was caused by our own breach of these terms or our negligence.

6. Paying for Cone Zone

Cone Zone is free for customers. Operators pay a subscription.

• Plans and prices are shown on the site before you buy, in Canadian dollars, and are charged in advance for each period.
• Payments are handled by Stripe. We never see or store your card number.
• Free trials are stated when offered. If you do not cancel before a trial ends, the subscription begins.
• You can cancel at any time from your dashboard. Your plan runs to the end of the period you have paid for and is not renewed.
• We do not normally refund part-used periods, though we will always listen — write to us.
• If a payment fails we may pause your listing until it is resolved.
• We may change prices. Existing subscribers get at least 30 days' notice before a change affects them, and can cancel instead.

7. Behaving reasonably

Please do not:

• post pins for trucks that are not there, or that do not exist
• impersonate another business
• use Cone Zone to harass anyone, or post anything unlawful
• scrape, copy or resell our data, or try to break into the service
• use Cone Zone to track a particular person's movements

We can suspend or remove an account that does these things. Where it is reasonable to do so, we will tell you why and give you a chance to put it right.

8. Things we cannot promise

We work to keep Cone Zone running and accurate, but we provide it "as is". We do not promise it will be uninterrupted, error-free, or available at any particular moment, and we may change or withdraw features.

To the fullest extent the law allows, we exclude implied warranties and conditions — including any implied promise that the service is fit for a particular purpose or that its content is accurate.

9. Our liability, and its limits

Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded. In particular, nothing here affects:

• liability for death or personal injury caused by our negligence
• liability for fraud or fraudulent misrepresentation
• any right or remedy you have under the Consumer Protection Act, 2002 (Ontario) or similar consumer legislation where you live, which applies despite anything said in an agreement

Subject to that:

• We are not liable for anything an operator does or fails to do, including the food they sell, the state of their vehicle, or whether they turn up.
• We are not liable for indirect or consequential loss, loss of profit, loss of business, or wasted time or travel.
• Our total liability to you, for everything arising out of your use of Cone Zone, is limited to the greater of the amount you paid us in the twelve months before the claim, or CAD $100.

Cone Zone is free for customers and inexpensive for operators. That is the bargain these limits reflect: we are not charging a price that could carry the risks of the businesses listed on it.

10. Content you post

You keep ownership of anything you post — your business description, photos, sightings. You give us permission to show it within Cone Zone, and to keep showing it while it is posted. You confirm you have the right to post it.

We can remove content that breaks these terms or the law.

11. Ending things

You can stop using Cone Zone and close your account at any time. We can suspend or end your access if you break these terms, if we are required to by law, or if we stop offering the service. If we stop offering a paid service, we will refund any period you have paid for and not received.

12. Changes to these terms

We may update these terms. If a change materially affects you, we will give reasonable notice — by email or in the app — before it takes effect. If you do not accept a change, you can stop using Cone Zone and, if you pay us, cancel.

13. Law and disputes

These terms are governed by the laws of Ontario and the laws of Canada that apply there. Disputes go to the courts of Ontario.

If you are a consumer, this does not take away your right to bring a claim where you live, or to use any consumer protection process available to you. Nothing here requires you to arbitrate a claim you are entitled to bring in court.

Before anything formal, please just write to us. Most things are a misunderstanding and take one email to sort out.

14. The rest

• If part of these terms turns out to be unenforceable, the rest still applies.
• Not enforcing something once does not mean giving it up.
• These terms, with our Privacy Policy, are the whole agreement between us about Cone Zone.
